What you are buying

A single, original, hand-made painting. Every work is unique. No edition, print or reproduction of it will be sold. See Authenticity.

Prices and currency

All prices are in US dollars and cover the artwork only. Shipping is quoted separately after purchase — see Shipping & returns. Import duties and taxes in the destination country are the buyer's responsibility.

Reservations

Beginning checkout places a temporary hold on a painting so that nobody else can buy it while you complete payment. If checkout is not completed the hold lapses and the work returns to sale. A hold is not a purchase and confers no ownership.

Payment

Payment is processed by Stripe. Ownership transfers when payment has been received in full and the work has been delivered. The studio reserves the right to cancel and refund an order where a painting has been listed in error, priced in error, or is unexpectedly unavailable — in which case you are refunded in full and told why.

Cancellation and refunds

You may cancel for any reason and receive a full refund at any point up until you approve the shipping quote. This includes after the painting has been paid for, and requires no explanation.

Once the shipping quote is approved, all sales are final. A crate is built to the dimensions of that specific work and insured freight is booked at that moment; those costs are committed and cannot be recovered. The work is not returnable thereafter, whether or not it has yet left the studio. Commissions are final from the moment work begins.

This does not affect your position if something goes wrong: work damaged in transit, misdescribed, or sent in error is resolved by refund or restoration, and is handled as an insurance matter rather than a return. See Shipping & returns.

Refunds are returned by the original payment method and typically appear within five to ten business days.

Where the law of your country grants consumers a statutory right to cancel that cannot be excluded by agreement, that right applies and is unaffected by anything above.

Copyright

Buying a painting transfers the physical object, not the copyright. Santiago Aburto retains copyright in all works and in all photographs of them, and may continue to reproduce images of a sold work in portfolios, exhibition materials and on this site.

As the owner you may display the work privately or publicly, lend it, and resell it. You may not produce prints, merchandise or other reproductions for sale, or use images of it commercially, without written permission — which is usually given when asked.

Commissions

Commissions are agreed separately in writing before work begins, covering subject, size, timescale, and payment schedule. Because a commission is made specifically for one buyer, it is excluded from the standard return terms.

Liability

Nothing in these terms limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited. Beyond that, the studio's liability in connection with any sale is limited to the amount you paid for the work.

If anything here is unclear, ask before you buy — write to the studio. It is a one-person operation and the reply comes from the artist.
